Congratulations to Fox Broadcasting for winning a major skirmish in Hollywood's ongoing decency/indecency battle with the FCC! Now First Amendment rights crusaders like Cher and Nicole Richie can say the F-word on TV in prime time!
A New York appeals court said Monday that the FCC's standing rule against "fleeting expletives" on TV doesn't make legal sense and might be unconstitutional. Fox was in hot water because Cher and Nicole Richie both spiced up their comments during the Billboard Music Awards with some naughty words. (U2's Bono later let loose with the F-bomb on a 2004 NBC Broadcast.)
The New York appeals court even said the FCC was acting "arbitrary and capricious" by saying Fox and other networks can't air fleeting expletives. That's about the worst thing you can say about a regulatory agency whose authority over decency issues is questionable to begin with. And believe me, FCC chairman Kevin Martin is p*ssed!
"If ever there was an appropriate time for Commission action, this was it," Martin says in a statement Tuesday. "If we can?t restrict the use of the words 'fuck' and 'shit' during prime time, Hollywood will be able to say anything they want, whenever they want." Pretty salty talk for the normally-mild-mannered Martin.
Fox needs to make hay while the sun shines here. The network should make its court victory the basis of a whole new branding campaign. Here's my suggestion for the network's new tagline: "Fox: Now with Fleeting Expletives!"
But I'm still confused. As it now stands, saying the F-word and the S-word on TV during prime time is OK, as long as its done in a "fleeting" manner. Well, define "fleeting." Oh yeah, I know: "I could never succeed in intelligibly [defining obscenity], but I know it when I see it." Thanks for nothin', Justice Stewart.
Thankfully we're not flying completely blind. Cher and Richie provide instructive examples of how to toss off juicy four-letter words in a "fleeting" manner. Observe.

Instead of crying to the Supreme Court (as it certainly will), maybe the FCC should really reverse its TV obscenity policy, but just for Fox. The commission should require each lame Fox sit com and reality show to use at least 30 "fleeting" obscenities during each show. For Fox, which has made a business of pushing decency standards, there'd be no more envelope to push.
What have things come to? I am actually disgusted to read that this language will be allowed freely on prime time TV. Very sad indeed! I would hope that many parents will opt to get rid of the TV all together. Small children listening to this language on TV will get the impression that this type of language is freely accepted by everyone everywhere - when in fact it is not. What about parents and families who are trying to teach their children to speak to others with respect and kindness? This certainly won?t help.
Nobody has to worry about the kids learning "curse" words from TV because they have already heard them at school, on the playground, and from other adults including parents.

I, for one, could care less if they're using such language. I police what my children watch instead of letting the FCC do it for me. I also instruct them in the proper use of the language instead of allowing television to be their teacher.
Put another way, if one is doing their job as a parent, one need not worry about a few "fleeting expletives" that they will hear on the playground, anyway. If they are taught properly in the first place, it won't matter what they'll hear...
But, hey, what do I know? I'm only raising three children anyway, with one who will be in college at sixteen...
I think this is pretty great. True freedom of speech. TV is ridiculous because by censoring language, it's not realistic. Just like people who don't care to hear cursing or to expose their children to crude language in the real world can choose to avoid certain situations, they can choose to avoid certain TV shows. It just makes sense. *I* want to decide for *myself* what offends me. I don't want some government office deciding that for me.
It is refreshing to see the courts reach an intelligent decision in this matter. I have always wondered what makes broadcast media so "special" as to need the oversight of the FCC. Anyone picked up a Stephen King novel lately? One of the most famous American authors in history and every book is filled from cover to cover with expletives. And yet, I've never seen a Barnes and Noble clerk tackle a 12 year old in the aisle. Why should there be a difference between the printed version and the made for TV movie? Would the FCC like to tell me what my children are allowed to read as well?
Finally we did something right. And as you can see there are idiots who still think that censoring TV is bad... KIDS HEAR THIS LANGUAGE IN SCHOOL ALL DAY. Censoring it just makes it more of a 'taboo' which in turn results in MORE use of the word.
The reason broadcasters are subject to speech limits is that they -- unlike print media -- have a monopoly on the airwaves they lease. Those airwaves are owned by the public, and the government has given a specific individual a monopoly to operate it. This fact has always been used by the Supreme Court to justify censorship of the content delivered via that public trust.
Oh, no! People are saying naughty words! The fabric of the universe will unravel! Fuck you, prudish American pricks! You think it is decent to drop bombs on people in dirt huts, but you become offended because somebody says, "shit."
Why is this even debated? If they decide what can and can't be said and done and shown on TV, why do they even have the TV ratings system? Isn't that to tell you what level of language and such is in the program? If they keep stuff like that from the airwaves, won't the rating system be pointless if they're already policing it? And parents, quit letting TV be your babysitter and maybe you won't have to worry about the f or s words being said.
I'm good with this ruling, but, also, I'd like to see fleeting smoking, and maybe some fleeting graphic intercourse, too. If possible, I'd like to view brief moments of confederate flags flying modestly and hear racial slurs, except, "nappy" and "ho" when put in the same sentence because that would be hurtful and time consuming.
Come on, FCC, put HBO programming on regular TV. The kids are probably downloading anyway.

Back in the 70's the toilet culture began, hit its heyday in the 80"s and then the sewer culture began in the late 80's early 90's, and is now coming into its own. From the toilet to the sewer, all that have excrement for brains and zero morality follow the flow, or the flush in this case. Those of us who are actually of intelligence, possessing real thoughts, already know how everything ends for the sewer workers..

I do not use that language, nor do I condone the use of such language, but I also don't think it should be up to the government to decide what can and cannot be said.
Let the networks air what they want. If advertisers or the public don't like it, the money will dry up and they'll be forced to stop airing the offensive material or go bankrupt. If the money keeps rolling in, well, then I guess the public is getting what they want.
I have children. I am trying to raise them as decent, moral people. I carefully monitor what they watch on television. As a parent, it's up to me to instill values in the children. I'm not going to leave this to the networks or the gov't.
Finally, if anybody has any real problems with the content, remember, the TV has an "off" button for a reason.

I don't believe in censorship, but I also believe in teaching when certain language is appropriate. I don't care if someone uses the word 'fuck' in a conversation, but if they use it when I'm interviewing them for a job, they're not going to get it! I've always thought using cursewords too much makes you look ignorant ... but at the same time, maybe this will be a good thing, because now TV shows can say things like, "Cher is a dried-up fucking douchebag" or "Nicole Richie is a vapid pole-smoking piece of shit."
The argument is that "the people" aka government own the airwaves and therefore have the right to tell the Big Monopolies that air them what they can/can't say. If government is truly doing the will of the people, why not give the people the right to decide what they want on the air?
At the end of the day, the so called big monopolies (because, CBS, News Corp, Disney, GE, Time Warner, Cox, Tribune, Gannett, and others are called a monopoly??) will only air what people are WATCHING. If no one tunes in, the show gets cancelled inside of a few airings.
As for our children, there is a ratings system in place and futhur disclaimers and cautions on especially graphic programming. Why are you still letting your children watch it despite these warnings? Personally, I don't care for F bombs and potty humor and will not be tuning into anything that has it. But just because I don't like the Supranos doesn't mean I should keep everyone else from seeing it.

*i*, as an adult, dont even want the constant bombardment of sexual and graphically violent images. *i* feel violated. i DO avoid them as much as possible but find that it is indeed IMPOSSIBLE. ive set my tv to block certain programs but that doesnt stop HBO from airing a commercial from their cat show while im watching another program. i go to watch a pg13 movie and there is previews for an R horror film right before which is scary to young children. skin and violence is all over the seemingly "innocent" shows on tv and now expletives? u really think that exposure is all up to the parent these days with these constant bombardments now making their way to mainstream?i know this wave of little 10 yr old girls wanting to be sexy wasnt learned from their parents. the only way we could truly raise our children ourselves is by moving to amish country. give parents a break from their already tough jobs and keep the smut in a later time slot.

Back in the 70's, George Carlin announced his list of the seven words you can't use on TV. We've used all of them and then some. This is a new millennium, which means its time to redefine decency and, in return, indecency.
Why are we so concerned about and focused on TV? Look at the 'popular music' that kids are buying now-a-days. Those 'parental warning' labels only work if the kid behind the counter selling the CD actually cares enough to notice.
Those words are only 'bad', 'obscene', and 'indescent' because we choose to label them as such. If we lost our need to attach those labels, usage of the affected words might actually decrease because the taboo in using them is gone. After all, isn't half the thrill of doing something illegal the fact that it's illegal in the first place? Make it legal and it loses its thrill.
In other words, I say to the FCC, fuck that damned bullshit.
Profanity is used primarily by those unfortunates in the entertainment industry (and elsewhere) who attempt to mask their complete lack of intellectual capacity for profound individual thought and self-expression.
Unfortunately, the court used the term 'fleeting expletives'. That, too will be way, way over their heads. Hopefully, their roadies can explain it to them.

FOX protested the potential punishment for "fleeting" obscenities. This means that scripted tv shows still cannot use obscenities without facing FCC fines.
What FOX objected to was when a person would suddenly blurt out a curse word on-air. Why should FOX be fined if Bono decides to drop the F-bomb during an awards broadcast? Or during a live interview someone uses a curse word?
These events are unpredictable and unscripted so it's not reasonable to assume that this can be completely controlled.
So, sorry, Mark Sullivan, you'll have to find another reason to hate the FOX network. You still cannot say #$%^ on prime time tv.
You know, I don't see why this is such a large issue, Canadian televsion has allowed to use of fleeting expletives for years now provided that they're used with moderation (aka. Average/Light use). No offence to you guys, but your censorship antics leave a lot to be desired for. Also, this is coming from someone who's done a research paper on Canadian and American Censorship Standards and Canada comes out on top in terms of allowing the freedom of expression and speech. Sometimes, expletives are the only thing that can be used to make dialog sound more natural.
Ex. A Crime Show - Mob members discussing a situation.
Politically Correct: 'You know, we're getting in to some crazy stuff here.'
- Now we know that mobsters aren't the politest people around and this puts them out of character.
Real/Proper Dialog: 'You know, we're getting into some crazy shit here.'
- Sounds more natural for a mobster and it's used in context of the dialog.
Hey pgallant, guess what? Those awards shows appeared during PRIME TIME TV.
And no I don't hate Fox. I don't know anyone at Fox. In my blog I try to point out what an unsympathetic poster child for free speech Fox is. Sorry you missed that. Fox cares much more about cheap nudge-nudge-wink-wink humor than it does about free speech.

I don't think this ruling gives the green light to swearing on prime time television, especially scripted shows. It just keeps the FCC from arbitrarily punishing T.V. networks because some one dropped an f-bomb on live T.V. I don't believe many reasonable people think expletives should not be restricted on prime time broadcast, but enforcement should be consistent.
You disregard the children argument, and you're missing the point. I'm an elementary teacher, but not a prude. Children should speak and behave like the children they are. Many of my parents monitor their kids, setting high standards for them. Yet, many don't. Excuses that they hear it from their parents or movies is true...but it doesn't make it right. Even in the 2nd grade, I battle 7 year old foul mouths. Now, those children have more credence to repeat more expletives. Exposing other children to their parents lack of parenting skills allows them to expose my disciplined kids to it, giving the idea that they can at least try it at school. It's already proven true before this new ruling. I hate the thought of our nation and children speaking "freely" whenever, wherever, and to whomever they choose.
If your parents prohibited this language when you were young, and you agree with this, you mock your own parents. Perhaps, this is why you agree. Abuse of freedom is a dangerous thing!

But aside from irrelevant hyperbole. The FCC as a commission was never set up to control "the content" of the airwaves. It was created to make sure that "airwaves" ie Radio frequencies were managed appropriately so you didn't have multiple stations attempting to broadcast at the same frequency. The sad reality that the FCC was granted broad power to censor speech was the fault of US populace. And even worse the US populace is still allowing the censorship because the majority of us aren't interested enough to protect our civil liberties. We are relying too heavily on the Judicial Branch of government. What happens when the Judicial Branch gets seeded with the sycophants and toadies to an Executive branch that wants to control the social fabric of our so-called free society.
I am tired of people saying the children this the children that I learned all the english swear words and some foreign too at school from other kids before the 6th grade. to all the people that say I can't police my kids so on and so forth YES you CAN your just to LAZY to do it so you blame others for all the bad that happens. just the other day I was at the market a mother was there with a child who looked no more then 8 years old he asked for a candy bar she said, "We are going to eat dinner soon." the kid said "Fuck you bitch get me the candy bar!" You know - it comes to my attention that the FCC is trying to set standards here, saying that broadcasters can't do this and can't do that. But no matter what the FCC tells us what we can and cannot do, we always find a way around the system - just like our federal goverment. It's the public face of America, censorship - I think as soon as the govmt sets their iron foot down it no longer becomes a democracy, but a dictatorship. Here's the catch, the govmt has 1 big iron foot, but there's quite a few million people out there with shotguns ready and willing to fire. Time for Comedy Central to air the South Park episode where they dropped the f-bomb some 40 odd times. The joke and the point was hearing fuck unbleeped the first few times was funny but by the end of it everyone was so tired of hearing the f-word that they kind of got bored and tuned it out.

Meaning that if you're happy saying "fuck" or "shit" or any other word is naughty or "cursed", then please return to the witch trials where that kind of ideology is accepted. Your kids are not immoral for saying shit, any more then they are for saying sugar instead. Both words can be used for the same feeling. Just ask really1 if she punishes a 7 year old student for saying "oh sugar i spilled my milk" or the one who says "oh shit, i spilled my milk"? Both kids said they're word of choice for the same reason, so why does one get punished and not the other? As far as the candy bar incident(McOwnage's post) the child's use of language is not important, the mother giving in to her child, her subordinate child is the problem. Even if the child had of said "mommy i want a candy bar please" over "Fuck you bitch get me the candy bar!" mommy should have stayed firm and not given in, she's a poor parent.

No, millerm84, I don't punish a "sugar" substitute for "shit". Unoffensive words ARE available & necessary because children must vent frustration, anger, or surprise. Refusing that "freedom" can cause harm. Limits are meant to prevent chaos. Expecting high standards is the job of a teacher. I even have the responsibility to set & expect high standards in the way my students are or aren't allowed to express or behave when in my care. Perhaps, a role model who provides an alternate way of handling emotion is needed ... for some children, sadly, have no limits. Do they have to follow my rules? You bet, as much as possible when in my charge. I can't control what happens outside of school, but while in my class or when moving on, they'll have witnessed a more peaceful, less volatile, way of expression.
THESE are CHILDREN! It's about common decency, not religion.

Over six thousand years of recordesd scripture and the fact the Jesus isn't dead, should be enough to convince, but rarely does. Yes, they do have a right to express themselves as they wish. It's obvious from the actions and ramblings of the entertainment industry that they are completely lacking intelligence and class. Unfortunately, too large a segment of the public exhibits no higher level of intelligence by fostering their behavior. The only way to cope with them is to completely ignore them. By tuning them out, we cut the snake off at the head by reducing their revenue. Since greed, not quality, is the driving force in the industry, it's the only way to control them. All of this misses the point entirely. Speech is a tool used by humans to communicate an idea, thought, or emotion.
Using the term "sexual intercourse" is permissable both on the air, and in "polite society". It causes one to conjure one and only one image. Similarly the euphamism "making love" is universally acceptable. It is inane to say that one word or phrase is allowed while another (the f-bomb for all of you puritans) is considered obscene when both convey exactly the same thought.
Excrement, poop, caca, manure, doo-doo, all fine. Say the word "shit" and they're on you like "stink on ....". Well, you get the idea.
What image comes to mind when you hear someone say "penis" or "vagina", neither of which is banned from the airwaves? Utter any of the other myriad words that convey exactly the same thought and you're an instant leper.

In the 1300's Geoffrey Chaucer dropped the F bomb in his Canterbury Tales and civilization managed to survive (you may not find it in a modern English copy, but it's in the original Old English).
We also managed to get through the "wardrobe malfunction" in a relatively intact fashion as well as the various spicy scenes in NYPD Blue. When the novelty wears off we'll still be here.
Along about the time I was four or five I mouthed off to my mother about something. I have absolutely no idea what I said but to this day I can still taste the soap. And that was 70+ years ago!
Perhaps the world just needs a bit more soap.
People should not worry about what children say or hear due to the fact that they will hear these words at some point in there life. We should worry more about teaching our kids about what is and what isn't the appriate moments in our day to day lives in useing such language.
I also have to say that the american public makes me laugh at how they get upset over a few simple words that have been determined to be obscene, immorale, and dirty. Well my fellow readers, we use language everyday in our culture (america) that is construde as being unmentionable in other cultures, and we see nothing dirty about them. So in a nut shell we use simple language everyday here as a normal part of our speach that we would be chastized for useing in another culture. Chill out and move on with living your lives and try not to let it bother you.

What the fuck does morality have to do with being a potty mouth??!! I learned how to curse quite inventively, but I've yet to roll a convience store or pop a cap in somebody's ass. In fact, at the age of 4, my son correctly used the word asshole in a sentence. I was so proud; altho I did have to instruct him to not use it around his grandmother - who would have beat *my* ass..lmao.
But you know what??? Both my kids are in college and are not juvenile deliquents and have high grades. Imagine that! I have 2 wonderfully intelligent and creative children who are on the road to success. They were taught by my family & myself to be respecful to others and if one of them said "Bitch, buy me ..."
